1. Agreement to Terms

By accessing or using DCB Bank's services, website, mobile applications, or any banking products, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and DCB Bank Limited.

If you do not agree with any part of these terms, you must not use our services. Please read these terms carefully along with our Privacy Policy, which is incorporated herein by reference.

2. Account Opening and Maintenance

2.1 Eligibility

  • You must be at least 18 years of age (or legal age in your jurisdiction)
  • Estonian residents must provide valid KYC documents (ID card, passport, etc.)
  • NRI customers must comply with FEMA regulations
  • Business accounts require valid business registration documents

2.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access or security breach
  • You must maintain minimum balance requirements as applicable
  • You must update your KYC information periodically as per Estonian FSA guidelines

2.3 Account Closure

Either party may close an account with prior notice. The Bank reserves the right to close accounts that violate these terms, show suspicious activity, or remain dormant beyond the regulatory threshold.

3. Internet and Mobile Banking

Security Requirements

  • Use strong, unique passwords and change them regularly
  • Never share OTP, PIN, or password with anyone
  • Ensure your device has updated antivirus software
  • Always log out after completing your session
  • Use only official DCB Bank apps and websites

Liability: You are liable for all transactions conducted using your credentials until you notify us of any unauthorized access. The Bank is not liable for losses arising from your negligence in safeguarding credentials.

4. Transactions and Payments

4.1 Transaction Limits

Daily transaction limits apply based on your account type and transaction channel. Limits may be modified by the Bank with prior notice. You may request limit adjustments subject to verification.

4.2 Transaction Processing

  • Transactions are processed during business hours; cutoff times apply
  • SEPA/SWIFT transfers are subject to Estonian FSA guidelines and timings
  • The Bank is not liable for delays caused by third-party systems
  • Incorrect beneficiary details may result in failed or misdirected transfers

4.3 Reversals and Chargebacks

Disputed transactions must be reported within 30 days. Chargebacks are subject to card network rules. The Bank will investigate and resolve disputes in accordance with applicable regulations.

5. Fees, Charges, and Interest

Service Charges: Applicable fees for account maintenance, transactions, and services are outlined in our Schedule of Charges. The Bank may revise fees with 30 days' prior notice.

Interest Rates: Interest on deposits and loans is calculated as per the published rates. Rates are subject to change based on Estonian FSA policy and market conditions.

Penalties: Penalties apply for insufficient funds, late payments, and non-maintenance of minimum balance as per the Schedule of Charges.

6. Loans and Credit Facilities

  • Loan approval is subject to credit assessment and documentation
  • Interest rates and repayment terms are specified in the loan agreement
  • Prepayment and foreclosure are permitted with applicable charges
  • Default in repayment may result in penalties and credit bureau reporting
  • The Bank may enforce security/collateral in case of default

7. Prohibited Activities

You agree NOT to use our services for:

  • Money laundering, terrorist financing, or illegal activities
  • Fraudulent transactions or identity theft
  • Unauthorized access to other customers' accounts
  • Transmission of viruses or malicious code
  • Violation of any applicable laws or regulations
  • Reverse engineering or tampering with our systems

8. Limitation of Liability

Force Majeure: The Bank is not liable for failures due to circumstances beyond its control, including natural disasters, war, strikes, system failures, or government actions.

Third-Party Services: We are not responsible for third-party services, products, or websites linked from our platforms.

Maximum Liability: Our liability is limited to the amount of the disputed transaction or as prescribed by applicable banking regulations.

9. Dispute Resolution

Grievance Redressal: Complaints should be directed to our Customer Care team or the designated Nodal Officer.

Banking Ombudsman: If your complaint is not resolved within 30 days, you may approach the Estonian Financial Ombudsman.

Arbitration: Unresolved disputes shall be subject to arbitration in Tallinn, Estonia, under the Estonian Arbitration Act.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Estonia. Any legal action or proceeding shall be subject to the exclusive jurisdiction of courts in Tallinn, Estonia.

11. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website and communicated through email or SMS. Continued use of our services after changes constitutes acceptance of the revised terms.
